When a Divorce Case Goes to Trial, What Issues are Considered and Decided Upon by the Judge?

Divorce cases, no matter how cut-and-dry they may seem, can sometimes take a long time to get through the court systems and finalize.  A number of factors may predetermine the length of the divorce case, but if you and your ex-wife cannot make agreements on anything, you can plan on the case going to trial and being decided by a judge.  But what exactly does the judge make decisions on?

The judge in divorce court will first address the division of property.  This means property, material goods, assets, etcetera will be split in a fair and proper way, and will be determined by a number of issues already pending through your divorce case.

If you have children, the judge will also decide upon who gets custody of the children, develops a vague and basic parenting plan for the parents to abide by, and decides on child support payments, alimony and maintenance that may be involved.  This will typically be based on each of the spouse’s incomes and financial situations.

The judge in a divorce case has a lot to consider, and must look at every aspect of the divorce itself to come up with a plan that works and is agreeable by all parties involved.  Although the judge may not make decisions that you necessarily agree with, he is typically required to make difficult decisions on his own and will try to be as fair and non-judgmental as he can.  Remember, though, that if the judge makes a decision that you do not agree with, you can always appeal the decision in the higher courts.

FAMOUS SPANISH JUDGE FACES CONTROVERSIAL SENTENCE

INTERNATIONALLY RENOWNED SPANISH JUDGE FACES SUSPENSION

Justice or revenge ?” is the tricky question raised by most of Spain.

The hapless Baltazar Garzon, better known as the Pinochet Judge, snubbed by Margaret Thatcher, is facing his own peers in what is now becoming an embroiled and distinctly disturbing tussle of ideologies. It is also putting a very large question mark on the nature of the Spanish Judiciary. The extraordinary Judge Garcon had become the pride of the Spanish nation for his involvement in the pursuit and judicial processing of culprits of genocide. His order for the expatriation of the London bound Argentinian ex dictator which the Iron Lady dismissed with the now famous remark “everything in Spain turns into a circus” caused an international furore This did not go well in Spain but Pinochet was sent back to Argentina to face his own people and eventual justice.

Today, Judge Garzon divides Spain into sizeable chunks of supporters and detractors who appear to fit neatly into both political parties. The accusers on the side of the Partido Popular, accuse him of an ambiguous charge of violating the terms of the quaint law governing investigations into the past. The law which was the product of the present socialist government, was intended to bring out into the open the well known massacres and masss burial of those who dared to affront the Spanish dictator Franco. The crux of the issue, according to the Supreme Court, is that Judge Garzon has overstepped his limit and put the judicial enquiry firmly into the political arena which the Partido Popular states is opening up old hatreds. Whilst there is a tendency among many to swear blindly in favour of the qualities of the dead Head of State, Francisco Franco, there is also a growing mayority who think that he was guilty of open genocide and that the countryside of Spain is littered with myriads of forgotten, tortured and massacred victims including whole families. The recent attempt to recover the body of the internationally accepted celebrity, Garcia Lorca, was also fraught with an incredible amount of “for and against” on both sides. The result is that many more have joined the ranks of those demanding family burial of their executed ancestors and it looks as if the figures are rising sharply. Demonstrations outside the court rooms where Baltasar Garzon has been tried, have increased in size and acclamations and it is feared that this could cause friction with pro and anti franco parties.

The Spanish Judicial system enjoys a nationaly advertised bad reputation for its inefficiency and political tendencies. Europe herself has criticised it for its torpid slowness and in the case of foreign investors, for its inaction against state abuse of power against them. Most Spanish families have been to court on one issue or another during the course of their lives and an unacceptably high number regularly for a wide variety of reasons. The filtering process at police level does not seem to exist and as a result the country is set to become the world leaders in court rooms and entire administrative buildings. Some cynics comment that the process is part of an intimidation process guaranteed to keep the people in line. Others propose that with the average length of any civil process taking up to five or even ten years, that it would be far better if these issues were handled by private enterprise before facing judgement or clogging up the rickety judiciary. Another item of cricicism has been the lenient attitude attributed to some Judges with respect to political and high ranking figures and the often harsh and merciless sentencing of people hardly able to defend themselves. It is true that whereas seemingly delincuent bankers accused of exploiting privileged information and others accused of political power abuse (like the “shoot to kill” policies that emanated from them), got off lightly in the former and cushioned shortened sentences for the latter, a poor peasant was horrendously jailed for allowing his flock to eat some protected plant species. His whole flock died in his absence with the resultant national outcry. A Judge in Malaga also struck against a separated Spanish wife in favour of a demand from the American courts for the return of the couple´s child to her American father. Whilst this of itself would not have struck public sensitivity, the dubious profile of the father was not investigated and the eight year old child was taken without the mother´s knowledge and bundled on to a flight like a parcel. The stricken mother who had brought up the child in Spain since she left the United States when the child was in its eighteenth month, caused a hue and cry that raised funds for her to see her captive child but was curiously run over on arrival by an unknown hit and run merchant. Although the Judge apologised for his behaviour it is one of many dictates that have not endeared the nation to this, almost autocratic veneer of the Spanish government system. The rank and file make no bones about calling them the Gods.

The scale of he subjective and often innappropiate sentences which are almost always ratified on appeal, were the subject of the present Prime Minister Zapatero´s criticism of the system who called out publicly recently, for transparency. He was equally insistent on the need to adopt the European and international tenet of “innocent until proved guilty”which is not the way things are handled in most Spanish court rooms. Because of this, the Spanish Judicial system is considered “subjective” and the product of twisted attempts to justify personal convictions either by the Judge or the state attorney. Whilst it is impossible to determine whether most sentences are equally tainted, it is a well known fact that some go beyond understanding. In Barcelona, a court ruled that a music licenced bar had broken the law consistently and fined its woman owner over a quarter of a million euros – much to the horror of a highly critical media. Additionally, cases of wrongful imprisonment for murder with claimed manipulated evidence from the start have raised public fears. Overly critical programmes of supposed cover ups have led to judicial reactions including the warrant of arrest of the persistantly media exposed and determined father of one of the tortured and killed teenage daughter who raised suspicions with hitherto discarded evidence that people at high level were involved in her murder. The scenario of the spoof movie murders was elaborate and the semi satanic rituals equally so, demonstrating a high participation of collaborators and audience. The crimes are one of many of a similar nature which according to the father, have not been seriously investigated and it is true and only one man languishes in prison for what many consider he was not the prime culprit. The arrest of the girl´s father was the result of his relentless appearances on television and radio with private investigators thrilling the nation with fascinating arguments that led to the closure of the highly popular night programme and his eventual arrest for “smearing” the police.

The present saga of Judge Garzon therefore is but the straw that could break the camel´s back and even more so when his translation by request of the European Union to join the staff at the International Court of Justice in The Hague has been blocked pending sentencing. Most of Spain and an increasing number of political representatives of a wide variety of countries see this as an attempt to keep the horrors of the civil war massacres hidden from the world at large and that supporters of the regime remain with a reasonable chance of regaining power. Where democracy would stand in this respect is as difficult to say as some aspects of the Spanish Judiciary which sins by its lack of transparency. The apparent lack of understanding of the difference between Law, Justice, the letter of the law and seeing that Justice is seen to be done, often forms part of the accusations against it by an increasingly bitter public.

Never Judge People by External Appearances

You may hear the sentence about “Anyone should not judge people by external appearances”. This statement is correct because what you see may not be real or may not be as you think they will be and their actions are, instead, what one should use to judge people because they can affect other people both in positive and negative way.

Firstly, what you see may not be real or may not be as you think it will be, so you cannot judge people by appearances. People in nice clothes can be bad or criminals and people with poor clothes may be good. For example, there was a study conducted by a university professor did research few years ago about how people judged others by clothes. The study was done by asking 20 people to score two persons who are a criminal in a nice suit and a teacher in poor dress based on credit and trustworthiness. The results showed that most people thought that the person in a nice suit was more trustworthy than the teacher. This means that most people were tricked. Hence, one should not judge people by appearance because what you see may not real.

Secondly, actions are a good measurement of people. Good actions can improve things or affect things in a positive way. On the other hand, bad things can cause trouble for many people. The example to support my reasons is a thought of Buddhism. The Buddhists believe that if people do good things, good things will get back to them. The action which are based on this believe is, for example, giving food to monks. Giving and donation is good action and Buddhists believe that they will get something good back to their life. In my opinion, at least something good that they will get is pleasant mind. They will feel happy that their giving or donation can help people in needs. Hence, actions are suitable to judge people.

Finally, I would like to persuade everybody to judge people by their actions and never judge them by their appearances. People can misunderstand or be tricked by external appearances, and their actions are, instead, suitable measurement which everybody should use to judge people.

In Bible versus Quran: The mother of Jephthah, the Judge, was a Prostitute

This is the seventh article of the series:

“The Foreigner woman in Bible versus Quran”

In the previous articles of this series, we have seen that Language-wise, the “foreign” woman or the “strange” woman is the alien or the exotic or the outsider woman.  However, the Bible has another opinion.

As confirmed by the Bible, the “foreign” woman or the “strange” woman is the non-Israelite woman or the non-Jewish woman.

As a result, all non-Israelite or all the non-Jewish women are “foreign” women or “strange” women.

This indicates that the women in the Bible are but one of two categories; they are either Legitimate (genuine) or Foreign (strange).

According to the inspired word of God, the Bible gives three examples of the foreign women; all of them were prostitutes.

As a matter of fact, all the foreign women in the Old Testament save Ruth are prostitutes or evil or robbers and they are unfaithful and they lead to death.

The first foreign woman was Rahab, the prostitute, who welcomed the spies and helped them against her country.

The second foreign woman, a prostitute, was the mother of Jephthah, a mighty man of valor who delivered Israel from the oppression of the Ammonites and judged Israel six years.

The third foreign woman was from Gaza. One day Samson went to Gaza, where he saw a prostitute. He went in to spend the night with her.

The most important one of these foreign women is Rahab the prostitute as the Bible calls her.

Rahab in the Old Testament (Joshua 2 and 6)

Joshua sent two spies to spy Jericho. They went and entered the house of a prostitute named Rahab and stayed there.  This Biblical verse throws some light about the importance of the women especially the prostitutes in the “world of spies”.   The king of Jericho sent this message to Rahab: “Bring out the men who came to you and entered your house, because they have come to spy out the whole land.

After invading Jericho, Joshua commanded: The city and all that is in it are to be totally destroyed. Only Rahab the prostitute and all who are with her in her house shall be spared, because she hid the spies.

Joshua had said unto the two men that had spied out the country, Go into the prostitute’s house, and bring out thence the woman, and all that she has, as you swore unto her.

And Joshua spared Rahab the prostitute, with her family and all who belonged to her; because she hid the men Joshua had sent as spies to Jericho; and she lives among the Israelites.  And Joshua destroyed with the sword every living thing in Jericho, men and women, young and old, cattle, sheep and donkeys.

Rahab in the New Testament

1) Matthew puts Rahab the prostitute, in the Genealogy of the Lord Jesus, as being one of family tree of the Lord Jesus.

2) Paul says: By faith the prostitute Rahab, because she welcomed the spies, was not killed with those who were disobedient.

3) James says: even Rahab the prostitute considered righteous for what she did when she gave lodging to the spies and sent them out by another way?

Rahab and Jericho; her citizenship was violated to the highest degree

Rahab was a Jericho citizen, she changed to the side of Jericho’s enemy and helped the spies; she did not listen to her king. She is a collaborator in the total destruction of her city.  Was she a turncoat to her country, was she an agent of the enemy and traitor to her homeland?

However, the Bible, especially the New Testament, honors Rahab very much!

It seems likely that helping the spies against your country is a relative issue; some believe that it is the top crime against your country although the others say that it is the sign of faith and righteousness!

Also, the cause of invasion of Jericho is not mentioned. Why did Joshua invade Jericho and destroyed with the sword every living thing in it, all men and women, young and old, cattle, sheep and donkeys.

It was total destruction of all forms of life, every living thing, men and all the foreign women, babies, girls, kids, even all the animals were killed.

I really do not think that God Love would be happy with such acts.

Also, I am not sure if you smart reader know that the sword is mentioned more than 400 times in the Bible (a year is 365 days!); and the sword is never ever mentioned in the entire Quran.

On the other hand, Joshua, Rahab, Jephthah, Samson, Jericho and Gaza are not mentioned therein in the entire Quran.

Moreover, the idiom “Foreign woman” is not found in the Quran; all women are equal in respect to their rights and responsibilities regardless of race, color, location etc.

Moreover, I wonder why Matthew and Mark insist that the splendid Saint Mary was an ordinary woman; she married Joseph who begot four children from her.

In the Quran, Saint Mary was one of the best four women ever walked on the earth. No man touched her; she was absolutely pure and virgin until she died. She was virgin all through her life from birth to death and no man has ever touched her. All respects, greetings and Peace are due to her and her son.

Nevertheless, both Matthew (13:55) and Mark (6:3) claim that Joseph begot four boys from Saint Mary; they were James, Joseph, Simon and Judas. These four boys are the four brothers of the Lord Jesus (four God’s brothers!).

Besides, the genealogy of the Lord Jesus in the Bible is composed of 42 generations according to Matthew-1 while it is composed of 55 generations according to Mark-3, i.e., there are 13 missed generations. These 42 or 55 generations are from Abraham to Joseph who married Mary and had four children from her.  On the other hand, the genealogy of the Lord Jesus in the Quran is only three words: “Jesus the Son of Mary!”  PERIOD

The Bible (New International Version)

Joshua 2:1

Then Joshua son of Nun secretly sent two spies from Shittim. “Go; look over the land,” he said, “especially Jericho.” So they went and entered the house of a prostitute named Rahab and stayed there.

Joshua 2:3

So the king of Jericho sent this message to Rahab: “Bring out the men who came to you and entered your house, because they have come to spy out the whole land.”

Joshua 6:17

The city and all that is in it are to be devoted to the LORD. Only Rahab the prostitute and all who are with her in her house shall be spared, because she hid the spies we sent.

Joshua 6:21

They devoted the city to the LORD and destroyed with the sword every living thing in it—men and women, young and old, cattle, sheep and donkeys.

Joshua 6:22

Joshua said to the two men who had spied out the land, “Go into the prostitute’s house and bring her out and all who belong to her, in accordance with your oath to her.”

Joshua 6:25

But Joshua spared Rahab the prostitute, with her family and all who belonged to her, because she hid the men Joshua had sent as spies to Jericho—and she lives among the Israelites to this day.

Hebrews 11:31

By faith the prostitute Rahab, because she welcomed the spies, was not killed with those who were disobedient.

James 2:25

In the same way, was not even Rahab the prostitute considered righteous for what she did when she gave lodging to the spies and sent them off in a different direction?

Judges 11:1

Jephthah the Gileadite was a mighty warrior. His father was Gilead; his mother was a prostitute.

Judges 16:1

One day Samson went to Gaza, where he saw a prostitute. He went in to spend the night with her.

Matthew 1:1, 5

1A record of the genealogy of Jesus Christ the son of David, the son of Abraham:

5Salmon the father of Boaz, whose mother was Rahab, Boaz the father of Obed, whose mother was Ruth, Obed the father of Jesse (the father of King David),

Matthew 13:55

“Isn’t this the carpenter’s son? Isn’t his mother’s name Mary, and aren’t his brothers James, Joseph, Simon and Judas?

The Quran

In the entire Quran, the term “foreign woman” is not mentioned therein; all women are equal in respect to their rights and responsibilities regardless of race, color, location etc.

To avoid repetition, the interested reader can read the previous six articles of this series: “The Foreigner woman in Bible versus Quran”.

Back to my question to the smart and interested reader:

Are the Scholars honest when they claim that the Quran is quoted from the Bible?
